What is a Process Server?
A Process Server is an individual who is authorized to execute a service of process upon a party to a legal action. The execution of a process is conducted by someone of the age 18 or older who is not a party to the suit. Anyone who serves more than 10 services of process within California during one calendar year is required to register as a Process Server in the county within which he or she resides. There are some exceptions to the rule (e.g. Sheriffs, Marshals, Attorneys and their employees, and other government officials). Visit www.leginfo.legislature.ca.gov (see Business & Professional Code Section 22350-22360 and Code of Civil Procedure 413.10-417.40). The laws are subject to change.
